On 26 September 2012, the Propter Homines Chair for Banking and Securities Law at the Institute for Financial Services will be providing a special lecture and discussion on the European Commission’s proposal of a directive on bank recovery.
The crises in the financial markets which have been affecting Europe since 2006 have focussed attention on the importance of system-relevant credit institutes for national economies. The national laws on bank restructuring in Switzerland, England and Germany in particular are, however, barely adequate to the demands related to the restructuring of banks which operate internationally. Against this background, the European Commission submitted its draft directive on bank restructuring in June 2012. The proposal made by the European Parliament and the European Council for a directive governing the framework for the recovery and resolution of credit institutions and investment firms is intended to create the necessary procedures and powers to ensure that bank insolvencies within the EU can be handled without their endangering financial stability or becoming a burden to tax payers.
On the occasion of the 4th Liechtenstein Forum on Banking and Securities Law, Professor Jens‐Hinrich Binder, LL. M., will introduce the commission’s draft and submit it to critical analysis. Professor Binder holds the Chair of Civil Law, Corporate Law, Banking and Capital Market Law at the EBS Universität für Wirtschaft und Recht in Wiesbaden and has recently accepted the Chair of Civil Law, Commercial Law and Business Law at the University of Tübingen. Professor Binder, who will hold a lecture in Liechtenstein, is a proven expert in bank insolvency law. He not only wrote his doctoral thesis as well as numerous articles on the subject, but is also an expert adviser to the Financial Commission of the German Bundestag and has been instrumental in the formulation of the German Bank Restructuring Act.
The forum is aimed at trustees, bank representatives, lawyers and solicitors working in the financial markets, employees of the financial market authority, as well as asset managers and fund managers. Interested students and scientists are also welcome. After the lecture and during the drinks reception, there will be an opportunity for informal discussion.
