The demands placed on lawyers, trustees, financial auditors, judges and public prosecutors, but also on legal staff in business and administrative sectors are constantly growing. A discussion of relevant current case law is therefore essential for practitioners in legal environments.
Taken out as D&O insurance and professional indemnity insurance for the liberal professions, such as lawyers, patent lawyers, trustees, tax advisors, and for investment advisors and intermediaries, third-party financial loss insurance is of great practical importance. Its design is considerably different from other types of liability insurance. This applies in particular to the policies, which follow the so-called claims-made principle in accordance with Anglo-American practice. In continental Europe, there are lively discussions about the permissibility of claims-made policies. Furthermore, third-party financial loss insurance often contain terms, such as claims series clauses and drop-down clauses, the interpretation of which is contentious in individual cases. In the German-speaking world, the number of legal judgments clarifying the points remains small. The lecture will explain the problems of applying the clauses common in practice using judgments as examples and there will be an opportunity for discussion.
