Trends and requirements in the legal environment of the foundation

Traditionally, the program of the Liechtenstein Annual Convention on Foundation Law is introduced with a review of the current case law and development of the decision-making practice of the Foundation Supervisory Authority (STIFA). In the second part, liability law issues of the members of the foundation council in the assertion of information claims by beneficiaries and directors' liability in Liechtenstein will be examined in more detail. The focus of the morning session will be concluded with a comparative legal view of Liechtenstein foundation law and the foundation law reforms in Germany and Switzerland. The subsequent panel discussion will be dedicated to the presented issues in the practice of Liechtenstein foundations and the current challenges for foundations and their stakeholders in Liechtenstein.

The afternoon program will initially focus on digitalization, as the disruptive developments of digitalization also pose new challenges for foundation law. To this end, the first two lectures will examine whether Liechtenstein's flexible foundation law can provide answers to these changes and what answers that may be.

In the subsequent block of lectures on philanthropy, current questions on responsible ownership as well as the framework conditions for an attractive philanthropy location will be examined in a global comparison. The subsequent panel will then provide room for questions on modern forms of philanthropy. Last but not least, the program will be rounded off with organizational and criminal law issues related to foundations.

Target Audience

Lawyers, trustees, judges, public prosecutors, employees in banks, insurance companies and financial service providers, jurists as well as any people interested in specifically gaining an understanding of foundation law issues.
