The European Union has spent over 40 years considering the question of whether, and to what extent, auditors of capital market companies should be held liable for damages caused to the audited company, above all however to third parties (e.g. investors, creditors, suppliers, lenders, employees and the state) having relied upon the accuracy and completeness of audited annual financial statements. In his lecture entitled “Current case law regarding auditors’ liability in Liechtenstein and Europe”, Professor Werner F. Ebke, LL.M., Director of the Institute for German and European Company and Commercial Law at the Ruprecht-Karls-Universität in Heidelberg, will tackle these questions from a legal and economic perspective. The event will be held from 6 p.m. to 8 p.m. on Thursday, 22 March 2012, in the University of Liechtenstein’s auditorium. During a panel discussion led by Professor Francesco A. Schurr and at the subsequent drinks reception, participants and speakers will have the opportunity to exchange ideas.
The unresolved issue of liability
The auditing of the periodic accounting of capital market public limited companies by independent auditors is an important instrument of internal corporate governance, and also helps to improve the efficiency of the capital market and the market for corporate governance. In industrialized countries, civil law is increasingly being used in addition to public (commercial) law and criminal law, with a view to implementing (capital-)market-oriented standards and to ensuring the effectiveness of capital market functions. The presentation on 22 March is aimed at lawyers, trustees, auditors and legal staff working in administration or the financial sector, as well as any other individuals interested in current case law.
